Email traffic for public release following legal events in Britain in relation 1. Patrick Byrt. to Aboriginal claims.

From: “Patrick Byrt”

will you release these four emails for general circulation and to the Greens and media now that researcher and journalist “Nic Maclellan” has twice this morning emailed material for the Greens and made it for general circulation ? I also will be broadcasting that to the BCC list ASAP and would prefer to have your materials attached there in the one email. I am cc’ing Gerry Georgatos now FHI.

Thanks Paul,

It was Glenn Giles, State Co-ordinator of ANTaR SA Inc., and he went to work (part-time) with Neil Gillespie at ALRM on the ALRM revival of the Anangu claimants. I asked him to contact you. I have worked on the material you’ve sent me since 1999 and got ANTaR SA to run with it after a mammoth task getting Glenn Giles to take up the issues from 1999 with Aboriginal Descendants and got ANTaR SA on board. Then after 10 years of single minded determination with your help a Melbourne born and educated British Barrister, Angela Ward, contacted ANTaR SA and offered to work pro bono on the issues for the Descendants in London and seek UK legal aid to run with the 2009 UK High Court case principles ( Mr Justice Foskett – Limitation trial summary, London , June 5th 2009 ).

I then arranged for ANTaR SA to get her a meeting with the Director of ALRM, Aboriginal man Neil Gillespie, and to organize a meeting with Descendants at ALRM to begin the process with ALRM backing and financial support. Glenn Giles was engaged by Neil Gillespie to be liaison with the Descendants and the issues that Angela Ward wanted attended to. She took on the case to obtain legal aid and then ANTaR SA was frozen out of the ongoing involvement and Glenn resigned from ANTaR SA and dumped on the organisation. Neil Gillespie then pursued the matter apparently without having got 100% commitment from the ALRM Board and was eventually sacked from ALRM after he engaged Hickman & Rose for an advise and report. Angela Ward was never paid apparently but received reimbursements for fares that were not approved by the board and this and the engagement of Hickman & Rose both outside the Commonwealth Attorney-General’s manual for the operation of Aboriginal legal services apparently precipitated the removal of the Director when approaches were made to the UK Foreign Office personally in the UK by the Director while he was there on leave. From then on the board has been determined to dump the whole activity and no word has come back to the Descendants from Angela Ward. She may still be interested to pursue the Descendants issues unless the 4 to 3 verdict in the vets case by the law lords at the UK Supreme Court in March 2012 has influenced her to also jump ship.

Will you release these three emails for general circulation and to the Greens and media now that researcher and journalist “Nic Maclellan” has twice this morning emailed material for the Greens and made it for general circulation ? I also will be broadcasting that to the BCC list ASAP and would prefer to have your materials attached there in the one email. I am cc’ing Gerry Georgatos now FHI.

Here’s the email and contact details which I did include in the original email:

the dose estimates based on british algebra are completely bogus and self serving. The supposed impossibility of a ground level nuclear cloud at 100 – 180 miles from detonation point is false.

Such clouds occurred repeatedly at such distances during era of nuclear testing.

See attached photo. The cloud produced beta burns on cattle – accepted by authorities. The skin rashes and other effects to humans was and is denied by these same authorities.

The photo is of a 1953 US nevada tower shot in the kiloton range, the distance from blast point is 100 miles, the radiation is such that lead box protection of the camera film was required by Fallini, a farmer and appointed AEC radiation monitor. Source: Under the Cloud: The Decades of Nuclear Testing
By Richard Lee Miller The cloud is light in colour, reflecting the sandy soil at the Nevada Test Site.

Here is the actual report attached. It is catalogued in the National Library with Lallie as the author, her oral history forms the first part and my analysis in the context of the US and Marshall Island events are in the second part. The US technical documents cited are proofs that the Aboriginal testimony is technically correct according to the information recorded in such documents as the technical manual on the effects of nuclear fallout by the US Special Weapons Unit, Glasstone, who was referenced selectively by the Royal Commission, and the US Congressional Record, which the Royal Commission ignored. The Royal Commission sought information from the US and yet none of the parallel events were mentioned by the Royal Commission. That is a complete abomination for in 1953 Fallini fought with the AEC over exactly the same symptom set as suffered by the Aboriginal people of Australia. The US Dept Energy archive, ordered public by Clinton, has a number of documents catalogued which confirm beta burn to livestock many miles from the Nevada Test site. It catalogues the correspondence between Fallini and the AEC. It confirms fallout dosage high enough to cause confirmed burn to cattle 100 miles from the test site.

It ignores humans.

Cattle will do, for the AEC used the cattle lesions as a comparison in the confirmation of beta burn to humans in the Marshall Islands.

It is the same thing. It is all the same. If one wants proof one searches the world. The proof also exists in the deep silt of our water storages and in the soil of the hotspots. It lies in the bottom of old rain water tanks. It is in the bone repository created under Project Sunshine.

This evidence must be presented as a unified whole. Excuse my frustration. But until people use the evidence available in the USA, they will keep loosing. And will continue to have legal actions aborted on the phony statements of British authorities who claim there is no proof when they know darn well there is . In America. We are talking about technical and radiological proofs and medical proofs. In the Marshall Islands in relation to humans and in the US , in livestock. The US authorities deny that the fallout which caused beta burn to cattle and the deaths of flocks of sheep affected humans in any way. Though the cattle burns were used in the assessment of the Marshall Islanders. (Pearson and Cronkite, AEC 1954)

I first spoke to you about this in 1999.

Hi Patrick sure, however talking with Lallie Lennon and Michele Madigan would be a good idea. I can email the report based on Lallies oral history – at the time of the Royal Commission and in the last few years one taken by Michele at Pt Augusta. I have the ARPANSA CEO’s letter in response saying the dose could not have caused harm and I have Andrew Collett’s email informing me that he was involved in a legal case in which on the basis of the medical evidence the court found that the injuries suffered were caused by bomb fallout (all this in relation to Totem 1).

The medical precedent is the Marshall Islanders. Even though Totem 1 was a year earlier. Further medical precedent is found in the case of Martha Bordoli Laird and her son and husband who both died in Nevada from leukemia. They suffered skin rashes, sore eyes, etc. Their livestock suffered skin lesions admitted to be Beta burn by the AEC. This was Warm Springs Nevada. about the same distance from the Nevada Test Site as Lallie was from Totem 1. The year was 1953.

Carol Gallagher can give more information.

The farmer, radiation monitor and photographer Joe Fallini Snr (now deceased) took photos of ground level or near ground level nuclear smoke clouds with a camera in a lead box (with a little hole in it for the lens. These photos have long been published. The legal case fought by Martha and Joe, who took up her cause, went on for years. Joe is dead, the family are exhausted from fighting and they also were active against the Nevada waste site. I think they want to be left alone.

But there is public record stuff. This was all going on at the time of the Royal Commission which could find no similar incident with all its efforts and resources. The best it could come up with was the Sedan test in Nevada which was an underground test. But in 1957, a Grey Mist was photographed by Joe Fallini Snr engulfing farming land and buildings over 100 miles from the Nevada Test Site. And this has been common knowledge in the USA since Fallini, an appointed AEC monitor, took issue with the organisation about what he found and about how it affected people and livestock. The symptoms are the same.

When you relate to the Marshall Islanders, you find in the US records that skin samples were taken from the Islanders and the AEC compared these livestock lesions. Beta Burn. This was 1954.

When you relate all that to what happened to Aboriginal people in Australia in 1953 there is no deviation from cause and no difference in effects. The Marshall Islanders are diagnosed radiologically – radiation caused the illnesses and deaths and miscarriages. Everyone else is medically diagnosed with no reference to the causative agent. It is denied.

That includes the Aboriginal people and the school children of Warm Springs and Dry Springs Nevada. Who suffered sore eyes, skin rashes the runs and the other symptoms.

There are precedents.

I have been talking about this for decades Patrick. Noone gets it.

Until you cross reference the different populations and compare them, they remain isolated events. But they are not isolated events in actual fact.

The attitude of the British authorities is not surprising. However, if one gathers evidence from the US tests and uses it in relation to the British Tests, the British tests are revealed as being dirtier than the US ones.

After all this time I do not think myself that briefing someone on the spot will do much. Noone gets it.

If you give me his email address I will email him a copy of the report. And the court case Andrew Collett informed me of is sealed and is not on the public record. But Andrew knows about it for he was the plaintiff’s solicitor.

The AEC proves the medical link between radiation exposure and disease in fallout affected people in 1954 Patrick. Britain can deny it but that denial flies in the face of nuclear history as it is written in the US Congressional Record.

Paul
